Asbestos Litigation
Wooden McLaughlin has years of experience addressing the range of asbestos cases, from product liability claims to contractor and premises liability claims. We understand the nuances of each case and the legal standards that apply depending on the nature of the claim.
Wooden McLaughlin has developed a national reputation for effective advocacy for its asbestos clients, serving in roles as national counsel, local counsel and trial counsel. Our attorneys have obtained defense verdicts in Madison County, Illinois, Philadelphia, Pennsylvania, and Marion County, Indiana. We have also served as co-lead counsel for the group of attorneys involved in the appeals that led to the enforcement of the Indiana Product Liability Act Statute of Repose to bar claims against product manufacturers in 2003. Serving in the same capacity, our attorneys obtained a ruling from the Indiana Court of Appeals confirming the defense bar’s position that bankrupt manufacturers of asbestos-containing products could be named as non-parties for purposes of fault allocation.
Through decades of asbestos work, Wooden McLaughlin has developed relationships with experts in medicine, state of the art and industrial hygiene on the key issues in such litigation. Asbestos cases often involve multiple defendants and require the effective coordination of defense arguments among multiple law firms and parties. They also require effective communication with plaintiffs’ counsel to avoid wasting the parties’ resources and to move these cases towards efficient resolution. Wooden McLaughlin’s longstanding relationships with both sides of the bar enhance its ability to work towards favorable outcomes for its clients.
Wooden McLaughlin’s experience with asbestos litigation has also enhanced its ability to deal with a variety of mass tort claims, and our leadership on such matters in Indiana is well established.
