
Insurance Coverage Counseling & Litigation
Issues regarding insurance and insurance coverage arise in a variety of contexts, including whether coverage is owed under a liability policy, what losses are covered under a property and casualty policy, whether claims are properly handled, defending and prosecuting declaratory actions relating to coverage issues across most lines of insurance, and assessing disputes between agents and insurers. Such matters may often involve detailed and complex coverage issues relating to large environmental, product liability and construction claims.
Although the majority of our work is representation of insurers, Wooden McLaughlin historically has represented both insureds and insurers in disputes involving coverage issues. We continue to do so. We regularly provide litigation, counseling and consulting services to our clients involving most lines of insurance. We regularly are involved in litigation over a variety of insurance coverage matters from complex environmental and construction defect claims to homeowner, auto, farm and general liability claims. We regularly defend insurers against contractual and bad faith lawsuits. We also become involved in litigation between insureds and insurers or between insurers dealing with defense and coverage obligations and priorities of coverage.
A substantial part of our insurance work involves matters other than litigation. We consult with and advise insurers, and sometimes insureds, as to initial coverage determinations involving losses and claims. We consult with insurers on claims handling processes and procedures. We evaluate and advise on matters regarding application of umbrella and excess insurance policies. Much of our non-litigation work is performed with a goal of avoiding the costs and necessity of future litigation over matters.
Our insurance practice involves us in dealing with clients both Indiana based as well as regional and national insurers and businesses. We regularly partner with out of state law firms in the handling of insurance litigation.
