Prenuptial and postnuptial agreements can protect individuals and their assets and avoid uncertainty and stress during the marriage. Some clients use prenuptial agreements (entered into before marriage) simply to confirm the separate property that each spouse brings into the marriage, while others use the agreement to separate their individual assets and define whether and to what extent certain laws will apply to assets acquired during the marriage. Postnuptial agreements (entered into after marriage) can address the same matters and issues, but are subject to certain conditions not applicable to prenuptial agreements.
